Revised Zoning Regs Now in Effect; Additions Include Design Guidelines for NHCenter District & Commercial Development, New Public Service Utility District

The Town’s revised Zoning regulations have been adopted and became effective on January 1 of this year. The new regulations are the result of a process that spanned several years and included two public input sessions. Notable in the revised Zoning regulations are the following:

  • Appendix 5: Design Guidelines –  New Hartford Center District, which seeks to “maintain and enhance the unique 19th Century feeling of New Hartford’s Town Centers”.  These designs guidelines are part of the zoning application process.  As part of the application process, plans will be reviewed by the Architectural Review Committee, which will advise P&Z members on the design aspects of the project (see Section 6.7 of the Zoning Regulations).
  • Appendix 6: New Hartford Design Guidelines for Commercial Development  These guidelines  ”strive to maintain and enhance New Hartford’s rural charachter, historic value and scenic charm” while recognizing the opportunities provided by new development.
  • In Article 5, the addition of a Public Service/Utility District.  The PSU District permits public and quasi-public agencies to conduct their customary operations without undue restriction, but restricts and prohibits them from engaging in activities outside of the scope of their customary operations.  Lands included in this PSU District are those owned by the MDC, telephone and electric companies and RRDD #1.  As discussed during last Wednesday’s (January 11, 2012) Planning & Zoning Commission meeting,  areas falling into this category will be added to the New Hartford Zoning map in the coming weeks.
